ATM Compliance, State by State

Click any state. Traditional cash-ATM surcharge law, money-transmitter license status for pure cash-dispensing operators, and crypto-kiosk regulation — sourced and current as of August 2026.

✓ Compiled & sourced August 2026
The short answer, before you click anything: no US state caps traditional cash-ATM surcharges, and every state exempts pure cash-dispensing ATM operators from money-transmitter licensing — that part doesn't change state to state. What genuinely varies is crypto ATM kiosk law, a completely different, unrelated business that has nothing to do with the cash machines this site teaches. It's included here specifically because headlines about "ATM regulation" are almost always about crypto kiosks, and that confusion scares off people who'd never touch a crypto ATM in the first place.

*Pure cash-dispensing only — adding check cashing, bill payment, or crypto conversion changes your regulatory status. Money-transmitter exemption applies at the federal level (FinCEN) and is followed consistently by every state's own statute for this activity; see sources below, including California's DFPI confirmation.

Not legal advice. This is an educational summary of the current regulatory landscape as of August 2026, not legal counsel. Crypto-kiosk law especially is moving fast — roughly 30 states have introduced or passed kiosk-specific legislation in the past two years, and the "none found" entries reflect the absence of a specific statute we could verify, not a guarantee none exists or will exist. Verify current requirements for your state before deploying capital, or ask inside the community.
